IP Practice Areas in Thailand
Specialist advice on securing, protecting, enforcing and commercialising intellectual property in Thailand.
How our practice fits together
Across the life of an IP right
Our IP practice areas in Thailand follow the life of an intellectual property, from securing protection and keeping it in force to putting it to commercial use and enforcing it.
Protect
Securing trademarks, patents, petty patents and industrial designs, and protecting copyright works and confidential information.
Maintain
Managing portfolios through renewals, annual fees, recordals and watch services, so that rights remain valid and enforceable.
Commercialise
Licensing, assigning and transferring intellectual property, and reviewing IP rights and risks as part of investments and other transactions.
Enforce
Addressing counterfeiting and infringement through investigations and enforcement action, and resolving contested matters through litigation.
A registered trademark is the foundation for protecting a brand in Thailand. We handle clearance, filing and prosecution before the Department of Intellectual Property, respond to objections and oppositions, and manage portfolios through renewals, recordals and ongoing watch services.
We protect technical inventions through patents and petty patents, preparing and prosecuting applications and responding to examination. Our work combines legal and technical expertise with accurate Thai translation of specifications, supported by advice on filing strategy and portfolio management.
Industrial design protection covers the appearance of products, including shape, configuration, pattern and ornamentation. We prepare and file design patent applications, handle prosecution, and advise on how design protection works alongside trademarks, copyright and patents.
Copyright arises automatically in Thailand, but ownership, permissions and evidence still need careful management. We advise on ownership of commissioned and employee works, copyright notification with the Department of Intellectual Property, licensing and permissions, and action against unauthorised use.
Confidential business and technical information keeps its value only while it remains secret. We advise on confidentiality agreements, internal protection measures and information shared with employees, manufacturers and partners, and support action where confidential information is misused.
We identify and address counterfeiting and infringement through investigations, evidence gathering and coordinated action with enforcement authorities. Programmes can include market surveys, raid actions, customs measures and online marketplace enforcement, with a clear path to litigation where needed.
When intellectual property matters become contested, we represent clients in administrative proceedings, civil litigation and criminal proceedings, including cases before the Central Intellectual Property and International Trade Court, and advise on strategy, settlement and defence.
Intellectual property creates value when it is used, licensed or transferred on the right terms. We advise on licence and assignment agreements, technology transfer, IP due diligence for transactions, and the recordal of licences and assignments in Thailand.
